These Terms of Service are a legal agreement between you and QuoteGenex LLC. They explain the rules for using the QuoteGenex website, application, and related services. By creating an account, accessing the platform, or paying for a subscription, you agree to these Terms.
If you do not agree to these Terms, you must stop using QuoteGenex.
1. Overview of the Service
QuoteGenex is a software service that allows businesses to build and share quote and pricing forms, collect customer information, generate estimates, and manage leads. Some features include automated pricing questions, AI assisted outputs, referral tools, and subscription based access.QuoteGenex may update features or change parts of the service at any time. Some features may be limited or become unavailable depending on your plan.
2. Eligibility
You must be at least 18 years old to use QuoteGenex. If you create an account on behalf of a business or organization, you confirm that you have the authority to bind that business to these Terms.You are responsible for everything that happens under your account.
3. Account Registration and Security
To use QuoteGenex, you must create an account and provide accurate and complete information. You are responsible for keeping your login credentials secure and for notifying us immediately if you believe your account has been accessed without permission.QuoteGenex is not liable for loss or damage caused by unauthorized access to your account.
4. Description and Availability of the Service
QuoteGenex aims to provide a reliable and stable service. However, the platform may have downtime due to maintenance, updates, third party issues, or other events.
QuoteGenex may modify, suspend, or discontinue any part of the service at its discretion. We will give notice when required by law.
5. Subscription Plans and Usage Limits
QuoteGenex offers a free plan and paid subscription plans. Each plan has specific limits related to forms, questions, services, AI calls, and other features.
Plans renew automatically unless canceled before the end of the billing period. Usage beyond plan limits may require upgrading.
Promotional offers or trials may be available at times.
6. Fees, Billing, and Taxes
Subscription fees are charged through our payment processor, Stripe. By subscribing, you authorize QuoteGenex and Stripe to charge your provided payment method.
Subscriptions renew automatically at the end of each billing cycle unless canceled before renewal.
QuoteGenex may change pricing. We will provide notice when required.
You are responsible for any taxes that apply to your purchase.
7. Refund Policy
QuoteGenex subscriptions are non refundable. When you cancel, your subscription will remain active until the end of the current billing period. No partial refunds or retroactive credits are provided.
The only exceptions are duplicate charges or billing errors, which will be corrected once verified.
8. Acceptable Use
You agree not to:
Use QuoteGenex for illegal or harmful activity.
Send spam or misleading messages to leads or customers.
Collect information from end users without proper consent.
Upload or share content that is abusive, offensive, or infringes on rights.
Try to reverse engineer, scrape, or bypass security or usage limits.
Interfere with or disrupt the platform or its infrastructure.
QuoteGenex may suspend or terminate access for violations of this section.
9. Customer Content and Lead Data
You own the content you create and the information you collect through QuoteGenex.
To provide the service, you grant QuoteGenex a limited license to store, process, and display your content and lead data. This license ends when your data is deleted from the platform.
You are responsible for ensuring that the data you collect from your customers is lawful and compliant with applicable privacy rules.
Data is stored in the Bubble platform infrastructure. Additional subprocessors may be used for operations such as email delivery, hosting, and analytics.
10. AI Generated Content and Estimate Accuracy
QuoteGenex may use artificial intelligence to generate questions, pricing suggestions, and other outputs. AI generated content is informational only and may not be accurate or complete.
You are responsible for reviewing and approving all estimates before sending them to customers.
QuoteGenex is not responsible for business decisions, losses, or disputes that result from the use of AI outputs.
11. Intellectual Property
QuoteGenex may use arAll intellectual property related to the QuoteGenex platform, including software, design, trademarks, and content provided by us, belongs to QuoteGenex LLC.
You receive a limited license to use the service while you follow these Terms. You may not copy, modify, distribute, or create derivative works based on the service.
If you provide feedback or suggestions, we may use them without obligation or compensation.
12. Use of Third Party Services
QuoteGenex uses third party services such as Stripe, email service providers, and infrastructure services. Your use of these services may require acceptance of their separate terms.
QuoteGenex is not responsible for outages, delays, or issues caused by third party providers.
13. Referral Program
QuoteGenex offers a referral program that allows users to earn commissions when referred customers purchase paid subscriptions.
Key rules include:
Each user receives a unique referral link.
A referral is valid only when a user signs up through your link and purchases a paid plan.
Commissions are tracked in your account but become payable only after the referred user remains active past any refund or dispute period.
You must connect a Stripe Connect account to receive payout transfers.
Commissions may be withheld or canceled in cases of fraud, misuse, self referrals, chargebacks, or violations of these Terms.
Excluded Countries
The referral program is not available to residents or businesses located in the following countries due to risk or compliance restrictions:
Afghanistan, Albania, Belarus, Burundi, Central African Republic, Congo (DRC), Cuba, Iran, Iraq, Lebanon, Libya, Mali, Myanmar, North Korea, Russia, Somalia, South Sudan, Sudan, Syria, Venezuela, Yemen, Zimbabwe.
QuoteGenex may update this list at any time.
14. Stripe Connect and Payouts
To receive referral payouts, you must create and connect a Stripe Connect account. You must agree to Stripe’s terms and ensure that your payout information is correct.
Payout timing may vary based on Stripe policies, banking delays, or compliance checks. You are responsible for any tax obligations related to referral income.
15. Privacy and Data Protection
Your use of QuoteGenex is also governed by our Privacy Policy.
We explain how we collect, store, and use personal data, and how you can exercise data rights. By using the service, you agree to the handling of data as described in our Privacy Policy.
You are responsible for the lawful handling of your own customer data.
16. Termination and Suspension
You may close your account at any time.
QuoteGenex may suspend or terminate your account for violations of these Terms, failure to pay, fraudulent activity, or risk concerns.
If your account is terminated, your access to some or all features may end immediately. Data may be retained for a limited time after termination.
17. Disclaimers
QuoteGenex is provided on an as is and as available basis. We do not guarantee that the service will be uninterrupted, error free, accurate, or secure.
We do not guarantee business results, revenue, customer conversions, or financial outcomes from using the service.
18. Limitation of Liability
To the fullest extent permitted by law, QuoteGenex LLC is not liable for:
Indirect or consequential damages.
Loss of profits, revenue, or business opportunities.
Loss of data or content.
Damages resulting from AI output or inaccurate estimates.
In all cases, the total liability of QuoteGenex LLC will not exceed the amount paid by the user in the past twelve months.
Some jurisdictions do not allow certain limits. In those cases, limits apply only to the extent allowed.
19. Indemnification
You agree to defend and indemnify QuoteGenex LLC from claims, losses, or expenses arising from:
Your misuse of the service.
Your violation of these Terms.
Your violation of laws or third party rights.
Issues from content or data you upload or collect.
In all cases, the total liability of QuoteGenex LLC will not exceed the amount paid by the user in the past twelve months.
Some jurisdictions do not allow certain limits. In those cases, limits apply only to the extent allowed.
20. Governing Law and Dispute Resolution
You agree to defend and indemnify QuoteGenex LLC from claims, losses, or expenses arising from:
Informal Resolution
You agree to contact QuoteGenex first to try to resolve any dispute informally.
Binding Arbitration
Any unresolved dispute will be settled through binding arbitration rather than court. Arbitration will be conducted on an individual basis.
No Class Actions
You agree not to bring class actions, group claims, or collective arbitration.
21. Changes to These Terms
QuoteGenex may update these Terms at any time. When changes are made, we will update the date at the top of the page. Continued use of the service after changes means you accept the updated Terms.
